Supreme Court Affirms Wada as Kogi PDP Governorship Candidate

The Supreme Court, on Friday, affirmed Musa Wada as the governorship candidate of the Peoples Democratic Party PDP in the November 16, 2019 election in the state.

Wada had lost the election to the incumbent governor, Yahaya Bello, who contested the poll on the platform of the All Progressives Congress.

He had challenged the outcome of the election at the Kogi State Governorship Election Petition sitting in Abuja but lost.

His team of lawyers had said they would appeal against the judgment of the tribunal which on May 23, 2020 dismissed his petition.

Had the Friday’s judgment of the apex court nullified his candidacy, he would have lost the right to continue to pursue an appeal against the tribunal’s verdict.

Justice Roland Olorunfemi of Kogi State High Court had sacked Wada as a candidate of the PDP on the grounds that the party did not conduct valid primaries.

The suit was instituted by Wada’s rivals in the party led by Abubakar Idris.

Following Wada’s appeal against the judgment, a three-man bench of the Court of Appeal in Abuja led by Justice Ibrahim Saulawa in its judgment on Tuesday upturned the lower court’s verdict.

On Friday, the apex court dismissed the appeal filed by Ibrahim Abubakar challenging Wada’s status as the candidate of the PDP in the November 2019 governorship poll.

Justice Amina Augie who read the lead judgment of the panel of the apex court’s Justices held that Abubakar failed to prove the alleged irregularities in the process leading to Wada’s emergence as the party’s candidate.

She described the appeal as an abuse of court process and academic exercise.

Justice Roland Olorunfemi of Kogi State High Court had sacked Wada as a candidate of the PDP on the grounds that the party did not conduct valid primaries.

Following Wada’s appeal against the judgment, a three-man bench of the Court of Appeal in Abuja led by Justice Ibrahim Saulawa in its judgment on Apiril 21, 2020, upturned the lower court’s verdict.

The Court of Appeal’s verdict was affirmed by the apex court on Friday.
